Terms of service.

Welcome to HopeFarmPetPortraits.co.uk (the "Website"). These Terms of Service ("Terms") govern your access to and use of the Website and the services provided by Carolyn Higgins ("I", "me", or "my") through the Website. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Website.

1. Services

HopeFarmPetPortraits.co.uk offers original and unique hand-drawn pet portraits. Each piece is bespoke and created specifically for the customer based on the photographs and descriptions provided.

2. Orders and Payments

Placing an Order: To place an order, you must provide accurate and complete information, including your contact details and payment information. After paying the booking deposit online, you will receive a communication from me requesting additional information, such as photographs of your pet and any specific details to enable me to produce the artwork.
Payment: Payments are processed through Stripe, which accepts credit cards, debit cards, American Express, Klarna, Clearpay, and other payment methods. You must pay a booking deposit upfront before any work will begin. The remaining balance is due before the artwork is dispatched.
Pricing: The price quoted includes delivery within the UK. For international orders, additional delivery fees will apply.

3. Delivery

Delivery Times: Delivery times are dependent on my waitlist and availability. As each portrait is bespoke, it may take several weeks or months to complete an order.
Delivery: Delivery is provided by a third-party courier. Delivery times may vary depending on the courier. I am not liable for any damage that may occur during delivery.

4. Cancellations, Returns, and Refunds

Cancellations: If you cancel your order, the booking deposit is non-refundable. This is to cover the cost of the work already done.
Returns and Refunds: As this is a bespoke service, returns and refunds are not accepted.

5. Finalisation of Order Details

Once you have provided the required information (photographs, descriptions, etc.), I will send you a final outline of the agreed brief. After this, no changes to the order are allowed.

6. Intellectual Property

The artwork produced is an original work by me, Carolyn Higgins. You may not reproduce the artwork for profit without my express consent. The copyright of the artwork remains with me unless explicitly transferred in writing.

7. Limitation of Liability

To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Website or the services provided.

8. Governing Law

These Terms are governed by and construed in accordance with UK law. Any disputes arising from or related to these Terms or the use of the Website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
